Court Hands Two-Month Rigorous Imprisonment in Pampore Assault, Outraging Modesty Case

Pampore, Aug 18, KNT: Nearly a decade after a violent altercation shook a family in Pampore, the Court of Judicial Magistrate Ist Class (JMIC) Pampore on Monday delivered a judgment of conviction against the accused, awarding them both imprisonment and monetary penalty.

The court sentenced the accused to two months of rigorous imprisonment and imposed a fine of Rs. 10,000, directing that in the event of default the convicts will undergo an additional month of simple imprisonment. Significantly, the magistrate ordered that the fine, once realised, be disbursed as compensation to the complainant, recognising the personal suffering endured in the episode.

The case traced back to 2015 when the complainant alleged that she and her family were subjected to physical assault, her modesty was outraged, and property damage was caused during the incident.

The prosecution built its case on witness depositions, corroborating medical records, and material evidence, all of which were accepted by the court as consistent and credible. After weighing the testimony and documentation, the magistrate ruled that the prosecution had firmly established the charges punishable under Sections 354, 323 and 427 of the Ranbir Penal Code.

The conviction was secured through the prosecution conducted by Assistant Public Prosecutor Naveed Sarwar Khan, whose preparation of the case file and effective courtroom advocacy drew the court’s attention to the gravity of the offence and the reliability of the evidence. His role was noted as crucial in ensuring that the case, long pending in the judicial system, reached its logical conclusion.

In its judgment, the court emphasised the broader principle that acts violating personal dignity and disturbing social peace cannot be treated lightly.

By awarding both a custodial sentence and a financial penalty, the magistrate underscored that the rule of law must prevail and that victims are entitled not only to legal recognition of their grievance but also to tangible compensation. [KNT]
